Tutor Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the ExpertTeacherTutors platform ("Platform") as a tutor. By creating a tutor account and using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. Eligibility
To register as a tutor on ExpertTeacherTutors, you must:
- Be at least 18 years of age.
- Be legally entitled to work in the United Kingdom.
- Hold genuine qualifications relevant to the subjects you intend to teach. Any qualifications listed on your profile must be accurate and verifiable.
- Accurately report your DBS (Disclosure and Barring Service) check status. Misrepresenting your DBS status is a serious breach of these Terms and may result in immediate account termination.
3. Your Profile
You are responsible for ensuring that all information on your tutor profile is accurate, complete, and up to date. This includes your qualifications, experience, subjects offered, availability, and pricing.
We reserve the right to verify any qualifications or credentials you have listed. We may, at our sole discretion, reject, suspend, or remove profiles that do not meet our quality standards or that contain inaccurate or misleading information.
4. Commission & Payments
The Platform charges a commission on each completed tutoring session. The current commission rate is 20% of the session fee and is subject to change with reasonable notice provided to you.
You will receive the session fee minus the platform commission for each completed session. Payments are processed via Stripe and transferred to your connected bank account in accordance with Stripe's processing timelines.
You are solely responsible for your own tax obligations, including but not limited to self-assessment tax returns and VAT registration and payments where applicable. The Platform does not provide tax advice, and you should consult a qualified tax professional if you are unsure of your obligations.
5. Session Delivery
You are expected to deliver all tutoring sessions as booked, on time and to a professional standard. This includes being adequately prepared for each session and delivering content appropriate to the student's level and learning objectives.
Repeated no-shows, late cancellations, or failure to deliver sessions as booked may result in warnings, temporary suspension, or permanent termination of your tutor account at our discretion.
You must maintain a professional standard of conduct at all times when interacting with students, parents, and the Platform.
6. Cancellations
Cancellations made more than 24 hours before a scheduled session will incur no penalty.
Cancellations made less than 24 hours before a scheduled session ("late cancellations") may be subject to penalties, including but not limited to reduced visibility on the Platform or account warnings.
Refunds to parents or students following a tutor cancellation are at the Platform's discretion.
7. Safeguarding
You must comply with all applicable safeguarding legislation and guidance when providing tutoring services through the Platform.
If you work with children or young people under the age of 18, you should hold a valid enhanced DBS certificate. Your DBS status will be displayed on your profile.
You must report any safeguarding concerns immediately to the Platform via the designated reporting channels, and where appropriate, to the relevant local authorities.
8. Intellectual Property
Any content you upload to the Platform, including but not limited to your biography, qualifications, and profile photograph, remains your intellectual property.
By uploading content to the Platform, you grant ExpertTeacherTutors a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Platform for the purposes of operating and promoting the service. This licence ends when you remove the content or close your account.
9. Platform Circumvention
You agree to keep all communication, bookings, and payments for tutoring services on the Platform. You must not, directly or indirectly, encourage or arrange to provide tutoring services to students introduced through the Platform outside of it.
Specifically, you must not:
- Share your personal contact details (including email address, phone number, social media handles, or personal website) with students or parents through the Platform.
- Accept direct payments from students or parents outside of the Platform's payment system.
- Arrange tutoring sessions outside the Platform with students who were introduced to you via the Platform.
- Ask students or parents to contact you off-platform or through any other service.
The Platform uses automated detection to identify messages containing contact details. Such content may be automatically redacted, and repeated attempts to circumvent the Platform may result in warnings, suspension, or permanent termination of your account without notice. Where substantial circumvention has occurred, we reserve the right to recover lost commission and take further legal action.
This clause protects the integrity of the Platform, our ability to provide safeguarding oversight, payment protection, and dispute resolution for all users.
10. Termination
Either party may terminate the tutor relationship at any time by providing written notice. You may close your account at any time through your account settings or by contacting us.
Upon termination, any outstanding payments for completed sessions will be honoured and processed in accordance with the standard payment schedule. Termination does not affect any rights or obligations that have accrued prior to the date of termination.
11. Limitation of Liability
To the fullest extent permitted by law, ExpertTeacherTutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.
Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Platform shall not exceed the total commission fees paid by you to the Platform in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
12. Changes to Terms
We may update these Terms from time to time. We will provide reasonable notice of any material changes, for example by email or by displaying a notice on the Platform. Your continued use of the Platform after such changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
